Hurricane Damage Mediation Program

Updated: Nov 2, 2021

Do you have less than $50,000 worth of Hurricane Ida-related damage to your home and feel like you are not being treated fairly by your insurance company? If so, you may want to take advantage of the mediation program sponsored by the Louisiana Department of Insurance.

What is it?

Mediation is a process in which opposing parties (you and your insurance company) meet with a neutral third party (the mediator) to resolve your differences. It is a very efficient alternative to filing a lawsuit.

Will I lose my right to file a lawsuit if I am not happy with the result?

No. If you are unhappy with the final dollar figured arrived at via mediation, you are not

required to agree to it. You may decline your insurance company’s final offer and proceed with litigation.

How much does it cost?

The mediation fee is set at $600 and is paid by the insurance company. This fee covers a

mediation session lasting up to 1 ½ hours.

Where does the mediation take place?

This mediation program is being offered in the New Orleans area through Mediation and Arbitration Professional Systems (MAPS) and in the Baton Rouge area through Perry Dampf Dispute Solutions. You may request a specific mediator.

Can I bring my attorney with me to mediation?

Absolutely! Not only can you bring your attorney with you, but you may also bring with you an expert witness, such as a contractor or an appraiser, as well as any estimates, receipts, etc. that support your claim.

When will I get my money?

If your claim is resolved at mediation, your insurer will send you a check within 10 days.
